There are some common misconceptions surrounding probate and one I’ve heard more than once, from the proverbial ‘mate down the pub’, is that if a person leaves a Will, then they won’t require probate. In actual fact, under the Administration of Estates Act 1925 you can only obtain a grant of probate if the deceased left a Will.
