You’ve got the power: HM Courts and Tribunals Service offering refunds for overcharging powers of attorney

Snap – January and February are already over… and so too are overcharges for lasting and enduring powers of attorney from Her Majesty’s Courts and Tribunals Service (HMCTS).

Due to a profit of around the £8 million mark, HMCTS are now providing customers with a refund if they made an application for either an LPA or EPA during the period 1 April 2013 to 31 March 2017.

The refund amounts are relatively small – approximately £35 – £50. However, the claims are simple to make and need no professional input; they can be filed online and ‘take about ten minutes’. Once the claim has gone through you can expect the refund within 12 weeks.

Claims can be made even if the donor has since passed away. If this is the case then you may need to obtain a grant of probate.
